Enrichment Class Waiver & Release Form
Amaya Papaya LLC, doing business as Mindful Play Learning (“MPL”), provides enrichment classes and programming in mindfulness, yoga, play, and creative activities for early learners and youth at participating schools and childcare centers. While every effort is made to create a safe and nurturing environment, participation in any physical activity carries inherent risks.
Acknowledgment of Program Nature
I understand that:
Mindful Play Learning classes are play-based and may include physical activities such as yoga poses, stretching, movement, dance, and sensory play.
Classes take place at my child’s school/center without parents present and are supervised by MPL staff and school staff as required.
MPL facilitators are independent contractors providing programming through Amaya Papaya LLC and are not employees of the school/center.
Assumption of Risk & Certification of Fitness
I hereby assume all of the risks of my child participating in classes with Mindful Play Learning, including, but not limited to:
Risks that may arise from negligence or carelessness on the part of the persons or entities being released.
Risks from dangerous or defective equipment or property owned, maintained, or controlled by them.
Risks due to the actions of other participants, facilitators, or third parties.
I certify that my child is physically fit, has not been advised against participation by a qualified medical professional, and has no health-related reasons or problems that would preclude participation in these classes.
Medical Release
I agree to notify MPL in writing of any medical conditions, allergies, or limitations that may affect participation.
In case of emergency, I authorize MPL staff and/or school staff to administer first aid and, if necessary, arrange for emergency medical treatment.
Waiver & Release of Liability
In consideration of my child being permitted to participate in MPL classes, I, for myself, my child(ren), my heirs, executors, administrators, successors, and assigns:
WAIVE, RELEASE, AND DISCHARGE Amaya Papaya LLC dba Mindful Play Learning, its instructors, staff, agents, representatives, volunteers, and the school/center from any and all liability, claims, or causes of action, including but not limited to liability arising from negligence or fault, for any death, disability, personal injury, property damage, property theft, or other incidents which may occur during or as a result of my child’s participation, including travel to and from classes.
INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE Amaya Papaya LLC dba Mindful Play Learning, its instructors, staff, agents, representatives, volunteers, and the school/center from any and all liabilities or claims made as a result of my child’s participation, whether caused by negligence or otherwise.
I acknowledge that these activities carry the potential for injury, serious harm, or personal loss. Risks may include, but are not limited to, those caused by facilities, equipment, environment, temperature, actions of participants, and lack of hydration.
Acknowledgment of Understanding
I understand that this Accident Waiver, Release of Liability, and Media Consent Form is intended to be construed as broadly as permitted by law to provide maximum protection to Amaya Papaya LLC dba Mindful Play Learning.
I CERTIFY THAT I HAVE READ THIS DOCUMENT, FULLY UNDERSTAND ITS CONTENT, AND SIGN IT FREELY AND VOLUNTARILY AS A COMPLETE AND UNCONDITIONAL RELEASE OF LIABILITY.
